Commercial Litigation and Alternative Dispute Resolution:
John C Kieran & Son has an expert team which deals with all forms of litigation:
From time to time our commercial clients become embroiled in difficulties and disputes relating to their business affairs. Disputes are often an unavoidable element of doing business. To those clients we offer strategic and practical advice for early and effective resolution of these disputes by way of mediation and negotiation. Where appropriate we vigorously pursue and defend our client’s legal and commercial rights in the courts.
In some cases the courts are not the appropriate forum for the resolution of business disputes, as clients may want to continue their business relationship once the dispute is resolved. For those clients mediation can be an effective means of dispute resolution. The newly constituted Commercial Court presents a forum where proceedings can be fast tracked so that commercial objectives are not lost while legal issues are being pursued.
Experienced lawyers represent our clients at every level in the Irish courts and in mediation and arbitration. Their expertise enables us to provide a speedy and effective solution for our clients in all commercial disputes.
Being involved in a road traffic accident or an accident at work can not only be a traumatising experience but can also have serious financial implications for clients. John C Kieran & Son are specialists in advising their clients of their position on claiming for personal injuries and the level of damages they may be awarded. Our aim is to ensure that you achieve fair and equitable compensation in a timely manner.
These services include, among other things, requesting medical reports and liaising with their doctor in assessing their injuries, engaging engineers to consider the facts of their case and prepare a report to support their action, dealing with the Injuries Board, lodging the necessary court documents, advising clients on the worth/value of their case and any settlement offers.
Medical Negligence is a very specialised area of law and requires particular expertise. John C Kieran & Son have vast experience in this area advising clients of their position on complications that have occurred while under the care of the medical profession.
John C Kieran & Son Solicitors advise on all aspects of the purchase, sales & remortgaging of both residential & commercial property. We have decades of expertise in acting for clients in the purchase and sale of new and second hand houses along with commercial properties such as pubs, commercial units and tax incentive properties.
Our expert and experienced staff will discuss the entire process with you along with liaising with estate agents, engineers and financial institutions on your behalf. We will ensure that your interests are protected at all times and that the transaction is dealt with speedily and efficiently.
We also advise on landlord and tenant law and on the drafting of leases tenancy agreements. So whether you are a landlord or a tenant, talk to us about the significant implications of both the Residential Tenancies Act 2004 and the Private Residential Tenancies Board.
The perceived image of rural life does not always reflect the commercial reality of running a farm business or other rural ventures in Ireland. There is an ever increasing number of issues of both European and Irish Legislation involving issues relating to registrations, government bodies, planning, environmental issues, health and safety, Employment Law and EU subsidy payments.
We ensure that our clients are provided with practical legal advice to deal with the issues, and if disputed matters cannot be resolved then we have extensive experience in dealing with arbitration, mediation, ombudsman, and ultimately District Court, Circuit Court and High Court.
Our firm has built up a niche practice, advising farmers in relation to all aspects of property, commercial and private legal matters and have years of experience in:
We provide personal advice in the areas of wills, estate planning, estates and probate. Our solicitors emphasise confidentiality and sensitivity when working with clients. We recognise that planning for the distribution of property and other assets after death involves some of the most important decisions that our clients will make.
Making a will gives legal standing to what you intend to do with your assets or possessions after death. While some wills can be very simple and straight forward, others can be very complicated with many considerations to take into account particularly were there are substantial assets. Issues may include tax considerations, legal right shares of spouses, prior gifts and advancement, previous marriages, the rights of adoptive or stepchildren. We advise on the many aspects of estate planning including the setting up of will trusts.
Our Probate Department aims to ensure that our clients’ affairs are in order at all times. We also provide a comprehensive service in the administration of estates post death. The tax liabilities incurred on inheritance are a complex area of the law. We have developed a strong reputation in managing the tax implications of estates and have a team of experienced Solicitors in the area.
With far more people in the workplace in small, medium and large firms, organisations and companies, there is the potential for disputes to arise from the employer/employee relationship.
John C Kieran & Son offer advice in relation to contracts of employment, both written and oral. Written contracts of employment give rise to more clearly identified rights and responsibilities for the employer and the employee and obviously give rise to less confusion in the long run. However every employer and worker has certain minimum rights and obligations.
We also advise on various areas of employment law which come within the ambit of the Rights Commissioner and the Employment Appeals Tribunal. These are the less formal forums of resolving disputes in employment law. You will find useful information at www.entemp.ie or you can source this information through our useful links section.
At John C Kieran & Son we have a range of expertise, combined with our commitment to developing a clear understanding of each client’s business goals, mean that we can deliver a focused and cost effective service to our clients. We also provide a full range of property law services to those of our clients who are developers, private, corporate and institutional investors, retailers, financial institutions, landlords and tenants. We frequently project manage new developments coordinating other professionals to arrive on target for opening of premises. When advising clients in new licensing applications, we coordinate the acquisition of the property and the activities of the professionals working on the project.
We advise extensively in relation to operational issues, such as staff training and our staff training manual is in use in the majority of licensed premises in the country. We also represent clients in prosecutions under the Licensing Code including after hours prosecutions and under age drinking prosecutions.
